Welcome to EH Perfumes. These Terms and Conditions govern your access to and use of our website and online store, including the purchase of perfumes, cosmetics and related products.
Please read these Terms carefully before placing an order. These Terms must be read together with any applicable Returns and Refunds Policy and Privacy Policy published on our website.
Nothing in these Terms is intended to exclude, restrict or waive any right or protection that consumers have under applicable South African law.

EH Perfumes is not currently affiliated with a separately identified external trade association or industry code of conduct. This statement does not limit any obligations imposed by law.
2. Definitions and Interpretation
“Customer”, “you” or “your” means any person who visits our website, creates an account, places an order or purchases a product from EH Perfumes.
“Products” means perfumes, cosmetics, body-care items and other goods offered for sale through our website. “Website” means the EH Perfumes online store and related pages operated by us.
References to applicable law include relevant South African consumer protection, electronic communications, privacy and other legislation, as amended from time to time.
3. Application and Acceptance of These Terms
These Terms apply to your use of the website and to orders placed through our online store. By using the website or placing an order, you acknowledge that you have had an opportunity to read these Terms.
If you do not agree with these Terms, you should not use the website or place an order. However, no provision of these Terms overrides a mandatory consumer right or legal requirement.
Any additional terms clearly presented for a specific promotion, product or transaction will apply to that promotion, product or transaction where legally valid and consistent with applicable law.
4. Customer Accounts and Website Use
Customers may purchase as a guest or create an account through the online store. You must provide accurate, complete and up-to-date information when registering and ordering.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, subject to any rights you may have where unauthorised access or activity was not caused by you.
You must not use the website for unlawful purposes, attempt to interfere with its operation or security, submit fraudulent orders, misuse payment systems, or knowingly provide false information.
We may suspend or restrict access where reasonably necessary to protect customers, prevent fraud, secure the website or comply with the law. Where appropriate, we will provide an explanation and an opportunity to resolve the issue.
5. Products and Product Information
We aim to display product descriptions, photographs, sizes, prices and other relevant information as accurately as reasonably possible. Product images are illustrative, and minor differences in screen display, lighting, packaging or presentation may occur.
Product availability may change. A product displayed on the website is not guaranteed to be available until the order has been accepted and stock has been confirmed.
If a material error affects a product description or listing, we may contact you to explain the issue and discuss the available lawful options. We will not use a listing error to remove rights you have under applicable consumer law.
6. Fragrance Descriptions and Inspired-By References
Where a fragrance is described as “inspired by” another fragrance, the reference is intended to help customers understand its general fragrance inspiration or scent profile.
Unless expressly stated otherwise, EH Perfumes products are not represented as being manufactured by, affiliated with, endorsed by or officially connected to the third-party brands referenced for fragrance comparison.
Brand names and trademarks remain the property of their respective owners. Product descriptions are not a guarantee that two fragrances will smell identical, perform identically or produce the same result for every wearer.
7. Pricing, VAT and Promotions
Prices are displayed in South African rand (ZAR), unless expressly stated otherwise. Applicable delivery charges and other transaction costs will be disclosed during checkout before you submit your order.
EH Perfumes is not currently VAT registered and does not represent itself as charging VAT. If our tax status changes, the relevant information will be updated as required by law.
We may offer discounts, promotional prices or special offers subject to the terms displayed for each offer, including any stated validity period, eligibility criteria and stock limitations.
We reserve the right to correct genuine pricing or listing errors. If an error affects your order, we will contact you before proceeding where required. If payment has already been made, any cancellation and refund will be handled in accordance with applicable law.
8. Orders and Order Acceptance
When you submit an order, you are making an offer to purchase the selected products at the displayed price and on the terms presented during checkout.
An order confirmation email or on-screen acknowledgement may confirm receipt of your order but does not necessarily mean that the order has been finally accepted or dispatched.
We may need to decline, cancel or query an order where there is a genuine stock issue, suspected fraud, a payment problem, an obvious pricing or technical error, or another lawful reason.
If we cancel an order after receiving payment, we will arrange any refund required by law. We will not use this clause to avoid a consumer’s statutory remedies.
Before final submission, please review your order details, delivery address, quantities and contact information. If the checkout process allows changes, use those controls to correct mistakes before completing the transaction.
9. Payment
Online payments are processed securely through PayFast, Ozow Instant EFT, or other verified payment gateways made available at checkout. Available payment methods may change from time to time.
Orders may be held until payment has been successfully authorised or received. We do not intentionally collect or store full payment card details where those details are handled by the payment provider. Payment processing is subject to the provider’s own terms and security procedures.
You must only use a payment method that you are authorised to use. Suspected fraudulent payments may be investigated and reported where appropriate and lawful.
If a payment fails, is reversed or remains unconfirmed, we may delay processing or cancel the affected order, subject to applicable law.
10. Delivery Areas, Couriers and Estimated Times
EH Perfumes primarily delivers to addresses within South Africa. Delivery availability depends on the destination and the options offered at checkout.
Depending on the delivery service selected or available, orders may be delivered through The Courier Guy, Bob Go, BEX Express or another service identified for the order.
Standard delivery is generally estimated at approximately 2–5 days, depending on the delivery option, destination, dispatch time and courier operations. This is an estimate and not a guaranteed delivery period unless we expressly confirm otherwise in writing.
Delays may occur because of courier disruptions, weather, public holidays, incorrect delivery details or circumstances outside our reasonable control. We will not rely on this clause to remove any legal responsibility that cannot lawfully be excluded.
11. Delivery Charges and Free Delivery
Delivery charges are calculated and displayed at checkout before you complete your order. Charges may depend on the delivery destination, parcel details and delivery service available.
EH Perfumes offers free delivery on qualifying orders over R950, subject to any clearly displayed conditions that apply to the offer. Unless expressly stated otherwise, the order total must meet the qualifying threshold before any applicable delivery charge is applied.
If a delivery promotion has additional restrictions, those restrictions will be displayed with the promotion or at checkout before you place the order.
12. Delivery Problems, Lost Parcels and Damage
Customers should provide a complete and accurate delivery address, contact number and any necessary delivery instructions.
If a parcel appears delayed, has not arrived within the expected timeframe, or arrives visibly damaged, please contact us at info@ehperfumes.co.za or WhatsApp +27 69 689 5060. Please include your order number and relevant photographs where available.
We may liaise with the relevant courier to investigate a delivery issue. Customers should report problems as soon as reasonably possible so that the matter can be investigated efficiently.
Nothing in this section makes the customer responsible for a loss, damage or failure that applicable law places on the supplier or another responsible party.
13. Returns, Exchanges and Refunds
Returns, exchanges and refunds are subject to applicable South African law and any separate Returns and Refunds Policy published by EH Perfumes. For public health and hygiene reasons, perfumes, body lotions, and body washes can only be returned for a change-of-mind or standard exchange if they are unopened, unused, in their original packaging, and with all protective seals intact.
We do not offer a general voluntary change-of-mind return arrangement beyond any rights provided by law. This does not remove statutory cooling-off rights or remedies that may apply to a particular transaction.
If a product arrives damaged, defective, incorrect or otherwise does not comply with the order, contact us promptly with your order number and details of the problem. We will assess the matter and provide the remedy required by applicable law.
Certain statutory return or cooling-off rights may be subject to conditions or exceptions depending on the type of transaction and product. Customers should contact us before returning a product for instructions. Do not send products to us without first arranging the return, unless applicable law requires otherwise.
Where a return is accepted or legally required, we will communicate the applicable return procedure, address, costs and refund process. Refunds will be processed within the period required by law and, where applicable, through the original payment method.

14. Product Safety and Use
Customers must use all perfumes, cosmetics, body-care products and other products sold by EH Perfumes in accordance with the instructions, warnings and precautions supplied with the product.
Fragrance and cosmetic products are intended for external use unless expressly stated otherwise. Avoid contact with the eyes, do not ingest products, and keep them out of reach of children. Customers should review the ingredients and product information before use, particularly where they have known allergies or sensitivities.
Customers should discontinue use if irritation or an adverse reaction occurs and seek appropriate medical advice where necessary.
EH Perfumes cannot guarantee that every product will be suitable for every individual. However, nothing in these Terms excludes or limits any consumer rights or remedies that cannot lawfully be excluded or limited under applicable South African law.
15. Gift Sets and Promotions
Gift sets, bundles, promotional products and limited offers may be subject to specific conditions displayed with the relevant offer. These may include stock availability, validity periods or limits on quantities.
If a promotional item becomes unavailable after an order is placed, we will contact the customer to discuss an appropriate solution, including any refund or other remedy required by law.
Promotional terms will not be interpreted in a way that removes mandatory consumer rights.
16. Intellectual Property
Unless otherwise indicated, the website’s original content, branding, logos, graphics, product photography, page design and written materials are owned by or used with permission by E and H Trading (Pty) Ltd, trading as EH Perfumes.
You may access and use the website for personal, lawful shopping purposes. You may not reproduce, republish, distribute, commercially exploit or modify our protected content without prior written permission, except where permitted by law.
Third-party names, logos and trademarks remain the property of their respective owners. Nothing on this website transfers ownership of third-party intellectual property to EH Perfumes.
17. Customer Reviews and Submitted Content
If the website permits reviews, feedback or other submissions, you must ensure that your content is honest, relevant and lawful and does not infringe another person’s rights.
You must not submit content that is fraudulent, defamatory, abusive, discriminatory, threatening, misleading or unlawfully discloses another person’s private information.
By submitting content, you grant EH Perfumes permission to use, display and reproduce that content for purposes connected with operating and promoting the store, subject to applicable law and any rights you retain. We will not knowingly present a review in a materially misleading way.
We may moderate or remove content where reasonably necessary, including where it breaches these Terms or applicable law.
18. Third-Party Services and Links
The website may use or link to third-party services, including payment processors, courier services, analytics tools, social media platforms and messaging services.
Third-party services may be governed by their own terms and privacy policies. EH Perfumes does not control every aspect of those services and is not responsible for matters outside its lawful responsibility.
The inclusion of a third-party link does not necessarily mean that EH Perfumes endorses all content or services provided by that third party. Customers should review the relevant third-party terms where appropriate.
19. Website Availability and Security
We aim to keep the website available, secure and functioning correctly. However, uninterrupted access cannot be guaranteed. Maintenance, software updates, hosting issues or technical faults may temporarily affect the website.
You must not attempt to gain unauthorised access to the website, interfere with its operation, introduce malicious code or bypass security measures.
We may suspend or modify website features when reasonably necessary for maintenance, security, legal compliance or business operations. These actions do not affect rights relating to orders already accepted or remedies required by law.
20. Fraud, Payment Disputes and Suspicious Activity
EH Perfumes may investigate transactions that reasonably appear fraudulent, unauthorised or connected with misuse of the website. We may request reasonable information to verify an order or payment, subject to applicable privacy and consumer protection law.
Where a transaction cannot be verified or payment is reversed, we may delay fulfilment or take appropriate action, including cancelling an order where legally permitted.
Customers who believe a payment was made in error or without authorisation should contact us promptly and may also contact their bank or payment provider.
Nothing in this section prevents a customer from exercising a lawful right to dispute a charge, report suspected fraud or seek a remedy.
21. Limitation of Liability
To the extent permitted by applicable law, EH Perfumes is not liable for indirect or consequential losses that were not reasonably foreseeable when the relevant transaction was entered into.
We are not responsible for losses caused solely by circumstances beyond our reasonable control, provided this does not exclude liability that the law places on us.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where such exclusion is prohibited, death or personal injury where liability cannot lawfully be excluded, or any other liability that may not legally be limited.
Nothing in these Terms limits a consumer’s rights or remedies under the Consumer Protection Act, Electronic Communications and Transactions Act, or other applicable South African law.
22. Indemnity
You may be responsible for direct losses reasonably suffered by EH Perfumes as a result of your unlawful use of the website, fraud, deliberate misuse of our services or infringement of another person’s rights.
This clause applies only to the extent permitted by law and does not require you to indemnify EH Perfumes for our own unlawful conduct, negligence where liability cannot lawfully be excluded, or breach of a legal obligation.
23. Complaints and Dispute Resolution
We encourage customers to contact us first so that we can understand and attempt to resolve any complaint fairly.

Please include your name, order number, contact details and a clear description of the issue. We will consider the complaint and respond within a reasonable time.
If a complaint cannot be resolved directly, you may have the right to refer it to an appropriate consumer protection body, regulator, ombud or court with jurisdiction.
Nothing in this section prevents you from exercising a statutory right or using a dispute-resolution process available under law.
24. Privacy and Personal Information
We collect and use personal information as reasonably necessary to operate the online store, manage customer accounts, process orders and payments, arrange delivery, respond to enquiries, prevent fraud and meet legal obligations.
Depending on how the website is configured, information may include your name, contact details, delivery address, order history, account information, transaction details and technical information relating to website use.
We may share relevant information with service providers where necessary to fulfil an order or operate the website, including payment processors, couriers, hosting providers and technical service providers. We do not authorise service providers to use personal information beyond their permitted purposes.
The website may use analytics and advertising technologies, including Google Analytics and Meta Pixel, to the extent these tools are enabled and configured on the website. Such technologies may collect technical or usage information in accordance with their configuration and applicable law.
We aim to handle personal information in accordance with the Protection of Personal Information Act (POPIA) and other applicable privacy laws. A separate Privacy Policy should explain our data practices in greater detail, including applicable rights and contact procedures.
Customers should review the Privacy Policy when published. Nothing in these Terms substitutes for any privacy notice or consent required by law.
25. Marketing Communications and WhatsApp VIP Channel
We may provide information about products, offers or brand news through email, WhatsApp or other channels where permitted by law and, where required, with the customer’s consent.
Customers can use the available unsubscribe or opt-out method for marketing communications. Opting out of marketing does not prevent us from sending essential communications about an order, account security or other necessary service matters.
Customers may choose to join the EH Perfumes WhatsApp channel using the link below. Joining the channel is voluntary and subject to WhatsApp’s own terms and privacy practices.
26. Electronic Communications and Records
By using the website or communicating with us electronically, you acknowledge that communications may take place by email, website notifications or other electronic means.
We may retain transaction records and related communications for operational, accounting, dispute-resolution and legal purposes, in accordance with applicable law and our data retention practices.
Electronic communications and records may be used as evidence where permitted by law. This clause does not remove any requirement for consent, disclosure, authentication or other formalities imposed by applicable law.
27. Changes to These Terms
We may update these Terms when our business practices, website features or legal obligations change. The latest version will be published on the website with an updated effective date.
Changes will generally apply from the stated effective date. Unless required or permitted by law, changes will not retrospectively remove rights attached to an order already accepted.
You should review these Terms periodically. Where the law requires specific notice or consent for a change, we will follow the applicable requirements.
28. Severability and No Waiver
If a provision of these Terms is found to be unlawful, invalid or unenforceable, it will be applied to the maximum extent permitted by law or severed to the extent necessary. The remaining provisions will continue to apply where possible.
A failure or delay by EH Perfumes to enforce a provision does not automatically waive the right to enforce it later.
No provision of these Terms overrides a mandatory legal requirement or a consumer right that cannot lawfully be waived.
29. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by a court or other competent forum with jurisdiction, subject to any applicable consumer rights, statutory procedures and rules governing jurisdiction.
Nothing in this section prevents a customer from approaching a competent regulator, ombud or consumer protection body where that option is available under law.
